Who is this service for?

This service is for professionals advising clients who have received a “not eligible for NHS Continuing Healthcare” decision and require an independent expert assessment of whether that decision is legally and evidentially sustainable.
It is particularly suitable where:

• An appeal is being considered
• A client disputes the reasoning of the Integrated Care Board (ICB)
• There is uncertainty about whether grounds for challenge exist
• A second opinion is required before escalation

Why independent review matters

CHC eligibility decisions are highly technical. Particular attention is given to cases where eligibility appears to have been influenced by the stabilisation of needs within a structured care setting (“well-managed need”), or where reasoning reflects local commissioning practice rather than strict application of the National Framework. These issues frequently sit at the heart of flawed CHC decisions.

An independent review provides clarity before significant time and cost are invested in escalation.

What the review covers

• Domain-by-domain analysis of the Decision Support Tool (DST)

• Review of the outcome rationale and decision letter

• Identification of procedural irregularities or departures from the National Framework

 

• Scrutiny of reliance on “well-managed need” principle and whether it has been applied in accordance with the National Framework

 

• Identification of inappropriate reliance on local policy, resource considerations, or social care frameworks inconsistent with national guidance

 

• Assessment of application of the Primary Health Need test (nature, intensity, complexity, unpredictability)

 

• Realistic assessment of appeal prospects
