This fixed-fee review service is designed for situations where a professional requires an independent second opinion on an NHS Continuing Healthcare decision before advising a client whether to pursue an appeal.

The review provides a structured independent analysis of an NHS Continuing Healthcare eligibility decision. It is designed for professionals who require a clear assessment of whether a “not eligible” decision is legally and evidentially sustainable before advising their client on the prospects of challenge.

The review involves careful examination of the Decision Support Tool, the eligibility recommendation and the supporting evidence recorded within the assessment process. Particular attention is given to whether the Primary Health Need test has been applied in accordance with the National Framework and whether the reasoning underpinning the decision can properly be sustained.

• Domain-by-domain analysis of the Decision Support Tool(DST) document
• Review of the outcome rationale and decision letter
• Scrutiny of relevant care and medical records
• Identification of procedural irregularities within the assessment process, or overreliance on local process over national policy
• Identification of breaches of the Framework, Practice Guidance and Standing Rules (2012)
• Assessment of how the Primary Health Need test has been applied and how this aligns with the evidence within the DST itself
