CHC is a fully funded package of care provided by the NHS for adults with significant, complex, ongoing health needs. Unlike adult social care, it is not means-tested. However, the eligibility process is complex, technical and often inconsistently applied.

3. Preparation and Representation

Once the evidential framework has been established, attention turns to structured preparation. Potential areas of challenge are identified in advance, and written representations are prepared and submitted to the relevant panel ahead of the meeting.

NHS Continuing Healthcare is a legal entitlement, not a discretionary benefit. The National Framework sets the legal test. 

​However, the boundary between health and social care is often blurred in practice, and eligibility decisions can be influenced by narrow interpretations of guidance or an over-reliance on local process.

Decisions must turn on the nature, intensity, complexity and unpredictability of needs - not on diagnosis, setting, cost or internal processes and policy.
